Independent and Sub-Contractors and Unpaid Overtime

It is common for employers in many industries to classify personnel who should be employees as “independent contractors”. This serves two purposes for the employer. First, the employer does not have to pay social security taxes for that employee, and second, the employer does not pay the employee time and a half for hours worked over forty in a workweek. If a worker works for only one employer, uses that employer’s tools, materials, facilities, vehicles, etc., and does not regularly work for multiple companies or employers, then the employee is most likely not legally an independent contractor, but is instead an employee.

If your employer has misclassified you as an independent contractor and you work more than 40 hours per week, then you would be entitled to recover all unpaid overtime worked for at least the past 2 years, plus a potential identical amount of compensation in liquidated damages.
